This website is operated by Happy Tomato. The terms “we”, “us”, and “our” refer to Happy Tomato. Please review Our Policy carefully. Our Policy applies to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors etc. If you do not agree with Our Policy, please do not use or browse our website and do not make a purchase. By making a purchase on the website, you automatically agree to all our terms and conditions and accept the policy of our website.
You agree to use our website for legitimate purposes and not for or in violation of any intellectual property or privacy law. You agree to provide us with accurate personal information, such as your email address, mailing address and other contact details to complete your order or contact you as needed. You agree to promptly update your account and information. We reserve the right to refuse service to anyone, at any time, for any reason. We reserve the right to make any modifications to the website, including terminating, changing, suspending or discontinuing any aspect of the website at any time, without notice. We may impose additional rules or limits on the use of our website. You agree to review the Terms regularly and your continued access or use of our website will mean that you agree to any changes.
Seed Guarantee
We guarantee your satisfaction with our seeds. Your acceptance of our guarantee acknowledges that growing results depend directly on growing conditions and the skills and practices of the gardener. These factors are out of our control and are the responsibility of the gardener. Therefore, we must limit our liability to the purchase price of the seed. We reserve the right to change prices without notice.
Return Policy
Seed Products
We will only refund money regarding Defective or Wrong Item(s) shipped. Please read all product descriptions carefully to choose the right product(s) necessary for your gardening needs. We will not be responsible for improper customer storage of seeds or seedlings. Germination is negatively affected by moisture, light and warmth. If you report Defective or Wrong Item(s) shipped, please provide photographs to help us better understand the issue and how we can solve it.
Seedlings
Seasonal items such as seedlings are not returnable. The Seedlings Sale and Delivery option should only be used if the billing/shipping address associated with the order is within Toronto, Vaughan, Mississauga, Markham, Richmond Hill, Aurora, Newmarket, Whitchurch-Stouffville, East Gwillimbury, Georgina and Uxbridge, ON area. Happy Tomato reserves the right to cancel any order that does not meet this requirement and will provide a refund to the original method of payment. If you are in doubt whether it is possible to deliver seedlings to your address or have a large order, please contact our customer service team info@happytomato.ca. We respond within 1-2 business days or earlier.
If there is an issue with something you purchased or for any questions regarding our Guarantee or Return Policy, please contact our customer service team info@happytomato.ca and we will do our best to help solve it.
Shipping Rates
Seed Products
Happy Tomato is committed to keeping shipping costs as low as possible. All orders will be sent through regular mail to each shipping address at the following rates:
- Lettermail (no tracking) – $3CA + Tax.
Based on our positive experience over the last 4 years this is the most popular option.
- Registered Lettermail (signature option, tracking and delivery confirmation) – $15CA +Tax.
Estimated delivery time are 5-14 business days. Please allow a reasonable time for orders to reach you. We are not responsible for shipments lost or undelivered using the Lettermail (no tracking) option, but If you feel your order has been unduly delayed please contact our customer service team info@happytomato.ca and provide us with your Order number and email.
Seedlings
The Seedlings Sale and Delivery option should only be used if the billing/shipping address associated with the order is within Toronto, Vaughan, Mississauga, Markham, Richmond Hill, Aurora, Newmarket, Whitchurch-Stouffville, East Gwillimbury, Georgina and Uxbridge, ON area. If you are in doubt whether it is possible to deliver seedlings to your address or have a large order, please contact our customer service team info@happytomato.ca. We respond within 1-2 business days or earlier. Seedlings are goods that are shipped at specific times of the year and require special handling therefore we use our own door-to-door delivery.
Seedlings are usually delivered between May 15th and June 5th. If you need an earlier delivery time, please specify it in the comments to your order.
The day and time of seedling delivery will be agreed with each customer individually via email or phone message. Your order is considered completed from the moment it is handed over to the customer.
We are not responsible for the theft or damage of your order if:
- the order is accepted not personally by the customer, but by any other person specified by the customer.
- You ask us to drop your order without personally accepting. In this case, we will delivery your order, take a photo and send it to your email and/or your phone.
From this moment on, your order will be considered completed and no further claims will be accepted.
If you have placed an order for seedlings but ignore our messages about agreeing on a delivery date, Happy Tomato reserves the right to cancel your order and will provide a refund to the original method of payment.
If you have agreed on the date and time of delivery and have not shown up, then Happy Tomato reserves the right to cancel your order with withholding payment for delivery and will provide a refund to the original method of payment.
Local Pickups
The Local Pickup shipping option is currently unavailable.
Canceling an Order
Seeds orders may be canceled provided the product has not been shipped.
Seedlings orders may be canceled provided at least 15 days before the agreed seedling delivery date.
To cancel an order, contact us as soon as possible at info@happytomato.ca and provide us with the order number.
Wrong Address
If you believe you have or you did provide the wrong address at checkout, contact us as soon as possible to either confirm or correct the address. All mails that are returned to us because of the incorrect / wrong address will need to be repackaged and new postage must be paid at the expense of the purchase.
